Die angemessene Dauer des Strafverfahrens beschaftigt sowohl die Rechtsprechung als auch das strafrechtliche Schrifttum. In diesem Zusammenhang auftretende Fragestellungen werden uberwiegend unter dem Topos des sog. Beschleunigungsgebots diskutiert. Dabei geht es aber nicht nur um Fragen der gebotenen Kompensation von uberlangen Strafverfahren, sondern auch um die Auslegung und Fortbildung des Strafverfahrensrechts im Lichte des Beschleunigungsgebots. Robert Pest legt dar, dass es sich beim Beschleunigungsgebot in Strafsachen im Grunde um ein Verbot vermeidbarer, staatlicher Verfahrensverzogerungen handelt, also kurz gesagt, um ein Verzogerungsverbot im Strafverfahren. Ausgehend von dieser Pramisse werden Berechtigung und Grenzen des sog.
