Dies galt selbst dann, wenn dieser die Bestattung verboten hatte. Die Verfasser des BGB griffen bei der Kodifikation des 679 BGB, der die verbotswidrige Geschaftsfuhrung ohne Auftrag zum Gegenstand hat, massgeblich auf den Rechtsgedanken der actio funeraria zuruck.
