Una de las funciones que ejerce la Sala de Consulta y Servicio Civil del Consejo de Estado, y que ha cobrado especial relevancia en los últimos años, consiste en "resolver los conflictos de competencias administrativas entre organismos del orden nacional o entre tales organismos y una entidad territorial o descentralizada, o entre cualesquiera de estas cuando no estén comprendidas en la jurisdicción territorial de un solo tribunal administrativo". Su impacto es de tal magnitud que al resolver esa clase de conflictos se garantizan los derechos fundamentales de las personas al debido proceso y a la defensa, dado que se define la autoridad que debe conocer una determinada actuación administrativa.
