The Constitution of Social Democracy

  • Categories: Law

This book is based upon the papers written by a group of leading international scholars on the 'constitution of social democracy', delivered at a conference to celebrate Professor Keith Ewing's scholarly legacy in labour law, constitutional law, human rights and the law of democracy. The chapters explore the development of social democracy and democratic socialism in theory and political practice from a variety of comparative, legal, and disciplinary perspectives. These developments have occurred against a backdrop of fragmenting 'traditional' political parties, declining collective bargaining, concerns about 'juristocracy' and the displacement of popular sovereignty, the emergence of populist political movements, austerity, and fundamental questions about the future of the European project. With this context in mind, this collection considers whether legal norms can and should contribute to the constitution of social democracy. It could not be more timely in addressing these fundamental constitutional questions at the intersection of law, democracy, and political economy.

This book provides a set of proposals for how best to guarantee effective enforcement of labour rights worldwide. The linkage between labour standards and global trade has been recurrent for some 200 years. At a time when the world is struggling to find a way out of crisis and is striving for economic growth, more than ever there is a need for up-to-date research on how to protect and promote labour rights in the global economy. This book explores the history of the field and also provides an overview of emerging trends and opportunities. It discusses the most recent problems including: the effectiveness and the role of the International Labour Organization (ILO) in the second century of its...

Rethinking Job Security

  • Categories: Law

This book critically examines the proper role of the law in protecting job security in the contemporary workplace. It provides a historical, theoretical, practical and comparative perspective on this under-researched, but fundamentally important, legal mechanism at a time when the pressure to deregulate and dilute worker-protective laws has taken on increased importance. The volume critically analyses both statute and case law from three advanced industrialised liberal democracies with a common law foundation, the UK, Australia and the USA, to understand the extent to which job security is realised. By applying a common approach and a conceptual framework that emphasises the complex relation...

Social Democracy After the Cold War

Social Democracy After the Cold War

"Despite the market triumphalism that greeted the end of the Cold War, the collapse of the Soviet empire seemed initially to herald new possibilities for social democracy. In the 1990s, with a new era of peace and economic prosperity apparently imminent, people discontented with the realities of global capitalism swept social democrats into power in many Western countries. The resurgence was, however, brief. Neither the recurring economic crises of the 2000s nor the ongoing War on Terror was conducive to social democracy, which soon gave way to a prolonged decline in countries where social democrats had once held power. Arguing that neither globalization nor demographic change was key to the...

Labor and Employment Arbitration

An extension of Labor Arbitration: An Annotated Bibliography, this volume intends to provide a larger sense of history, of institutional development, and of the abiding questions that have been raised in and about labor arbitration. The editors focus on substantial professional and academic studies of labor arbitration in the United States and Canada, drawing material from books, monographs, analytical articles in professional and academic journals, and selections from the proceedings of the meetings of academic and professional societies. In response to the changing demands made upon arbitrators, the editors have extended their coverage to include alternative dispute resolution and the Americans with Disabilities Act. A large section of the book deals with employment arbitration and matters such as wrongful discharge. Coverage of arbitration outside North America is also expanded in the current volume, which is based upon computer searches of the most widely used data bases and on cover-to-cover searches of the twenty leading journals in the field.

Regulating Strikes in Essential Services

  • Categories: Law

Designing a fair, effective and acceptable regime that will reconcile public interest and the public’s need for an uninterrupted flow of essential services on the one hand, while maintaining the freedom of collective bargaining on the other, is an ever more difficult public policy challenge. This book, the first detailed comparative analysis of existing legal and practical approaches across a spectrum of key national jurisdictions, provides a structured and insightful overview of the law and practice of regulating strikes in essential services. As such it can be of great value for public policy debate and the enhancement of national law in the field. The editors have assembled experts from...
