The First Amendment is the principle guarantor of speech rights in the United States. But the Supreme Court's interpretations of it often privilege the interests of media owners over those of the broader citizenry. Laura Stein argues that such rulings alienate citizens from their rights, corrupt the essential workings of democracy, and prevent the First Amendment from performing its critical role as a protector of free speech. Drawing on the best of the liberal democratic tradition, Stein demonstrates that there is a significant gap between First Amendment law and the speech rights necessary to democratic communication, and proposes an alternative set of principles to guide future judicial, legislative, and cultural policy on old and new media.
As a counterpart to research on the 1930s that has focused on liberal and radical writers calling for social revolution, David Welky offers this eloquent study of how mainstream print culture shaped and disseminated a message affirming conservative middle-class values and assuring its readers that holding to these values would get them through hard times. Through these close readings, Welky uncovers the subtle relationship between the messages that mainstream media strategically crafted and those that their target audience wished to hear.
Negotiating Democracy addresses issues that have defined the challenges and consequences of media transformation faced by new and emerging democracies. These issues include the dismantling of national broadcasting systems, the promotion of private independent and pluralistic media, the clash between liberal democratic and authoritarian political traditions, negotiations about the appropriate broadcast language, and the potential for free press and for freedom of speech. In the 1930s, the United States almost regulated advertising to a degree that seems unthinkable today. Activists viewed modern advertising as propaganda that undermined the ability of consumers to live in a healthy civic environment. Organized consumer movements fought the emerging ad business and its practices with fierce political opposition. Inger L. Stole examines how consumer activists sought to limit corporate influence by rallying popular support to moderate and change advertising. Stole weaves the story through the extensive use of primary sources, including archival research done with consumer and trade group records, as well as trade journals and engagement with the existing literature. Her account of the struggle also demonstrates how public relations developed in order to justify laissez-faire corporate advertising in light of a growing consumer rights movement, and how the failure to rein in advertising was significant not just for civic life in the 1930s but for our era as well.
