A competência jurisdicional para processar e julgar os crimes de trabalho análogo ao de escravo tem se tornado assunto polêmico na órbita jurídica brasileira. O Supremo Tribunal Federal entendeu que a Justiça do Trabalho não detém competência penal. A atual competência para julgar os crimes de trabalho escravo é da Justiça Federal, por interpretação realizada pela corte suprema. A Emenda Constitucional nº 45/04 ampliou significativamente a competência da justiça do trabalho, alterou o art. 114, I, concedendo à justiça obreira a competência para processar e julgar as ações oriundas da relação de trabalho. O crime de reduzir alguém a condições análogas ao trabalho escravo detém aspectos correlacionados à relação de trabalho, por essa razão deveria ser da Justiça do Trabalho a competência para processar e julgar esse ilícito penal.
