Precedent & Possibility

  • Categories: Law

Not a day goes by in present South Africa when the role of law, the rule of law, the independence of the judiciary and the future of constitutional democracy is not debated. This book will take the reader into the heart of the legal system, the understanding of which is necessary when wrestling with these pressing questions. The book examines a series of key cases over the past 60 years, the judgements in which changed the political or social landscape of the country. The choice of cases for inclusion in the book was made both to tell compelling and significant historical stories, as well as to illustrate the possibilities inherent in law, and the potential for its abuse and use. All of the chosen cases were ones where the country held its collective breath before judgement was delivered. Through the stories told, the reader will not only engage with critical aspects of South African history, but will be exposed to the manner in which the possibility of our new constitutional democracy is linked to the legal precedents, traditions and culture which were built up over the past century.

Social Justice in EAP and ELT Contexts

This book articulates an understanding of what is meant by the term social justice from a global perspective, drawing upon examples of practice from across a range of English for academic purposes (EAP) and English language teaching (ELT) higher education contexts. Presently, within western higher educational systems, there is a drive for greater integration of approaches that lend themselves to social justice. However, questions still remain about what that means in practice. This book seeks to answer that not by telling but by showing. It presents a series of chapters that act as vignettes into a diverse set of classrooms, contexts and countries, offering examples of how and where an epist...

Lawfare

  • Categories: Law

What happens when South Africa's tumultuous political life becomes entangled in the courts of law? Throughout the past 50 years, the courts have been a battleground for contesting political forces as more and more conflicts that were once fought in Parliament or in streets, or through strikes and media campaigns, find their way to the judiciary. Certainly, the legal system was used by both the apartheid state and its opponents. But it is in the post-apartheid era, and in particular under the rule of President Jacob Zuma, that we have witnessed a dramatic increase in 'lawfare': the migration of politics to the courts. The authors show through a series of case studies how just about every aspe...

'Language Teacher Education' is an introduction to language teacher training and development for teachers and providers in pre-service and in-service programmes. The text outlines the main theories of human learning and applies them to teacher education. Based on a broadly social constructivist perspective, it suggests a framework for planning pre-service and in-service programmes, and is illustrated both with case studies from a range of training situations around the world and appendices containing teacher education materials. Language Teacher Education is intended to inform readers' practical decisions and to help them build their own theories of teacher learning.

Beyond Devolution and Decentralisation

Beyond devolution and decentralisation compares the politics, policies and polity-building dynamics of devolution in Wales and decentralisation in the French region of Brittany. Empirically, the book draws conclusions from in-depth fieldwork within two regions and reports the findings of a comparative public opinion survey. Theoretically, it contributes towards our understanding of the comparative study of regions. Perhaps most impressive is how the case studies generally are based on, but also cast light back, to the nuanced theoretical framework on regional capacity established at the outset. The book uncovers the dynamics of devolution in Wales and decentralisation in Brittany through extensive face to face interviews: over 200 interviews were carried out from 2001 to 2004, a formative stage in the development of the devolved institutions in Wales and a period of expectation in Brittany as well. The book will be of interest to the professional research community and to practitioners in Britain, France and beyond, as well as to students on comparative politics, British/Welsh politics, French politics, European studies and public policy courses.

Contextualizing English for Academic Purposes in Higher Education

This book highlights the centrality of political and ideological issues as they relate to the positioning and practice of English for Academic Purposes (EAP), demonstrating that EAP cannot flourish as a profession or a discipline without an awareness of the macro- and meso-level political shifts that impact the wider university. The volume states that the practices of EAP are, in fact, political acts and examines these as yet unexplored power dynamics. The volume begins by considering key influences that have shaped universities and their governance and management over the last three decades and how these relate to the role and practice of EAP. These influences include neoliberal economic po...

Amy Biehl’s Last Home

In 1993, white American Fulbright scholar Amy Biehl was killed in a racially motivated attack near Cape Town, after spending months working to promote democracy and women’s rights in South Africa. The ironic circumstances of her death generated enormous international publicity and yielded one of South Africa’s most heralded stories of postapartheid reconciliation. Amy’s parents not only established a humanitarian foundation to serve the black township where she was killed, but supported amnesty for her killers and hired two of the young men to work for the Amy Biehl Foundation. The Biehls were hailed as heroes by Nelson Mandela, Desmond Tutu, and many others in South Africa and the United States—but their path toward healing was neither quick nor easy. Granted unrestricted access to the Biehl family’s papers, Steven Gish brings Amy and the Foundation to life in ways that have eluded previous authors. He is the first to place Biehl’s story in its full historical context, while also presenting a gripping portrait of this remarkable young woman and the aftermath of her death across two continents.
