Judicial control of public administration is essential for the realisation of the rule of law and democracy. To date, there is virtually no effective judicial protection in Afghanistan. However, a study of Afghan legal history suggests that the country has certain - currently underdeveloped - institutions that could be used as the basis for the creation of judicial control. Based on a historical study, the book elaborates the pluralist legal culture of Afghanistan, rooted in tribal and Islamic legal conceptions alongside a State legal system. The author proposes practical solutions for the development of judicial control of public administration in Afghanistan. Dr. Mirwais Ayobi has more than a decade of experience as an assistant professor of law and political science in Afghanistan. His work focuses on administrative law, constitutional law, public administration and judicial review.
This book offers an overview of the formation of the Afghan state and of the politics, economic challenges and international relations of contemporary Afghanistan. It opens with an account of some of the key features that make Afghanistan unique and proceeds to discuss how the Afghan state acquired a distinctive character as a rentier state. Die vorliegende Untersuchung befasst sich mit den allgegenwärtigen Fragen, welches rechtliche Schicksal der menschliche Körper nach dem Tod nimmt, ob der Leichnam vererbt wird und wer in welchem Umfang über ihn bestimmen darf. Die Autorin gelangt zu dem Ergebnis, dass das Totenfürsorgerecht als wesentlicher Bestandteil des - im Grundgesetz als Staatszielbestimmung zu verankernden - sog. postmortalen Persönlichkeitsschutzes auf die Wahrung der Pietät ziele und zuvörderst dem Willen des Verstorbenen verpflichtet sei. Bei unbekanntem Verstorbenenwillen dürfe der Totenfürsorgeberechtigte aber in einigen wenigen Bereichen auch eigene Entscheidungen über den ihm anvertrauten Leichnam treffen. Der Umgang mit dem Leichnam lasse sich bislang keinem bekannten Rechtsinstitut zuordnen und stelle Gewohnheitsrecht dar. Gegenwärtig herrsche Rechtsunsicherheit. Zur Behebung des gesetzgeberischen Defizits schlägt die Autorin ein Bundesgesetz vor und unterbreitet hierfür einen Gesetzesvorschlag.
Grund und Boden sind begrenzt und unvermehrbar. Es sollte somit davon ausgegangen werden, dass jeder Staat, insbesondere hochentwickelte Volkswirtschaften wie Deutschland, über eine gerechte Rechts- und Gesellschaftsordnung hinsichtlich der Zulässigkeit von Bodennutzungen verfügt. Das Baugesetzbuch zielt dagegen mit den Normen zur verbindlichen Bauleitplanung in Verbindung mit den Planersatznormen nur vorrangig auf eine bauliche Raumentwicklung. Es wird die These aufgestellt, dass für Deutschland die Erforderlichkeit einer gesamträumlichen verbindlichen Bodennutzungsplanung besteht, um die bodennutzungsrechtliche Entwicklung sozial- und umweltgerecht, nachhaltig sowie zukunftsorientiert zu gestalten. Vor diesem Hintergrund werden die einschlägigen BauGB-Normen beschrieben und analysiert. Die meisten Nachbarländer Deutschlands haben ein flächendeckendes verbindliches Raumnutzungsrecht etabliert. Erste Novellierungsvorschlägen werden aufbauend auf eine vergleichende Betrachtung des Schweizer Raumplanungsrechts, welches ein gesamträumliches verbindliches Bodennutzungsrecht verfolgt, formuliert.
This Masterplan project is the result of a long and intense collaborative relationship between the University of Florence and the University, the Department for Urban Development and the Municipal Council of Herat, set in motion in 2004. In 2011, with the financial support of the Direzione Generale per la Cooperazione allo Sviluppo (DGCS) of the Italian Ministry of Foreign Affairs, a systematic programme of analysis and planning of the urban area was undertaken, aimed at the formulation of a new strategic Masterplan (SMP) for the city of Herat. This planning approach, far from being based on a static vision of urban space, is an attempt to harness the most significant aspects of change and development, ensuring, at the same time, the deepest consideration of the specific geographic, cultural and social aspects of the area within a multidisciplinary approach.

European harmonisation efforts such as a European civil code, European constitutional treaties, European principles, and European fundamental rights are frequently criticised for building on or creating a European legal culture that does not exist; in reality what we have is European legal pluralism. Some have argued that the pluralistic structure of European law hinders the development of a community, which is a necessary requirement for a European legal culture. And if there can be no common European legal culture then there is no basis for harmonising exercises.The contributors to this book explore in different legal areas whether in fact the contrary is true. Cultural pluralism might indeed be a distinctive feature of European legal culture. Diversity is not something that is in opposition to, but rather constitutes a new, different understanding of European legal culture.
