The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Is it possible to decolonize, decommodify, and depatriarchalize the constitution? The authors speak from multiple geographies, raise different questions, resort to differentiated theoretical approaches, and reveal varying levels of optimism about the possibilities of transforming constitutions. The readers are confronted with critical perspectives on the Eurocentric legal canon, as well as with the recognition of anti-capitalist, anti-colonial, and anti-patriarchal legal experiences. In The End of the Cognitive Empire Boaventura de Sousa Santos further develops his concept of the "epistemologies of the South," in which he outlines a theoretical, methodological, and pedagogical framework for challenging the dominance of Eurocentric thought. As a collection of knowledges born of and anchored in the experiences of marginalized peoples who actively resist capitalism, colonialism, and patriarchy, epistemologies of the South represent those forms of knowledge that are generally discredited, erased, and ignored by dominant cultures of the global North. Noting the declining efficacy of established social and political solutions to combat inequality and discrimination, Santos suggests that global justice can only come about through an epistemological shift that guarantees cognitive justice. Nationalism, as an ideology coupling self-conscious peoples to fixed territories, is often seen as emerging from European historical developments, also in postcolonial countries outside Europe. André van Dokkum’s Nationalism and Territoriality in Barue and Mozambique shows that this view is not universally true. The precolonial Kingdom of Barue in what is now Mozambique showed characteristics generally associated with nationalism, giving the country great resilience against colonial encroachment. Postcolonial Mozambique, on the other hand, has so far not succeeded in creating national coherence. The former anti-colonial organization and now party in power Frelimo has always stressed national unity, but only under its own guidance, paradoxically producing disunity.
In current debates about coming to terms with individual and collective wrongdoing, the concept of forgiveness has played an important but controversial role. For a long time, the idea was widespread that a forgiving attitude — overcoming feelings of resentment and the desire for revenge — was always virtuous. Recently, however, this idea has been questioned. The contributors to this volume do not take sides for or against forgiveness but rather examine its meaning and function against the backdrop of a more complex understanding of moral repair in a variety of social, circumstantial, and cultural contexts. The book aims to gain a differentiated understanding of the European traditions regarding forgiveness, revenge, and moral repair that have shaped our moral intuitions today whilst also examining examples from other cultural contexts (Asia and Africa, in particular) to explore how different cultural traditions deal with the need for moral repair after wrongdoing.
